Terms of Service

1. Agreement to Terms
By accessing or using Pay-E ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Pay-E provides a software-as-a-service platform that enables Australian restaurants and food businesses to send tokenised Stripe payment links to customers for phone orders, take orders through a public ordering page, and track payment and order status. Pay-E acts solely as a technology intermediary. All payment processing is performed by Stripe, Inc. pursuant to their own Terms of Service.
3. Eligibility
The Service is available to Australian businesses with an active Australian Business Number (ABN). You must be 18 years or older and have the legal authority to bind your business to these Terms.
4. Your Stripe Account
You are required to connect your own Stripe account to use the payment features of the Service. Pay-E never holds, processes, or takes custody of funds on your behalf. All payment-related disputes, refunds, and chargebacks are governed by Stripe's policies and your agreement with Stripe.
5. Acceptable Use
You must not use Pay-E to:
- Facilitate any unlawful activity.
- Attempt to access another merchant's data, orders, or payment links.
- Send payment links for goods or services not legally available in Australia.
- Circumvent or interfere with the customer-flagging system designed to protect merchants from non-payment.
6. Subscription, Plans and Billing
Pay-E offers a tiered monthly subscription in Australian Dollars (AUD). Plan details (currently Starter and Standard, plus optional per-kiosk software add-ons and one-off equipment), and what each plan includes are described on the public pricing page and reproduced inside your dashboard at Settings → Plan & billing. Your subscription renews automatically each billing period unless cancelled before the renewal date. No refunds are issued for partial months.
SMS overage. SMS sent past your bundled allowance in a billing period is added to your next Stripe invoice at the published per-SMS overage rate for your plan.
Setup fee. A one-time setup fee may apply at the time of sign-up. The current amount is published on the pricing page and is waived on annual plans.
7. Data and Privacy
Customer phone numbers and order data collected through the Service are processed in accordance with our Privacy Policy. Sub-processors used to deliver the Service (including Stripe and Twilio) are listed on our Data Protection page. You are responsible for ensuring your use of customer data complies with applicable Australian privacy laws, including the Privacy Act 1988 (Cth).
8. Limitation of Liability
To the maximum extent permitted by law, Pay-E's total liability for any claim arising under these Terms shall not exceed the fees you paid in the 12 months preceding the claim. Pay-E is not liable for indirect, consequential, or incidental damages, including lost revenue resulting from customer no-shows or payment failures.
9. Service Availability
We aim for high availability but do not guarantee uptime. Planned maintenance will be communicated via the dashboard. We are not liable for losses resulting from service unavailability.
10. Termination
Either party may terminate at any time. On termination, your access to the dashboard is revoked. Order history may be exported within 30 days of termination upon written request.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes are notified constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
